Operator of illegal tire storage site fined $12K, given jail sentence

BELLEVILLE, ONT-Terry Piontek was sentenced to three months in jail and fined $12,000 for failing to comply with a provincial court order issued after he was previously convicted of illegally storing used tires. In April 2005, Piontek was convicted and fined $7,500 for violating section 190 of Ontario's Environmental Protection Act. A court order issued at that time required him to remove all used tires from his property within 180 days. Follow-up inspections by Ministry of Environment (MOE) staff, conducted between November 2005 and January 2006, found that Piontek had not removed the tires from the site as required by the order, nor had he paid the $7,500 fine. An investigation by the MOE's investigations and enforcement branch led to a charge of failing to comply with a court order, to which Piontek pleaded guilty.
