Illegal waste site operator sentenced for failing to follow court order
PICTON, ONT-Laverne Valleau has been sentenced to 60 days in jail followed by 60 days probation after pleading guilty to a charge under section 186(2) of Ontario's Environmental Protection Act (EP Act) of failing to comply with a provincial court order. Valleau was convicted in May 2005 on one count of operating, enlarging and extending a waste disposal site without the required certificate of approval, contrary to section 27(1)(b) of the EP Act. He was fined $110,000 and issued a court order requiring him to remove all illegal waste from the site by December 16, 2005. An inspection and subsequent investigation conducted in January 2006 by the Ministry of Environment found that Valleau had not removed the waste from the site, nor had he paid the $110,000 fine. He pleaded guilty to failing to comply with the court order and was sentenced, but has still not complied with the court order, nor paid the fine.
