Failure to report spill results in $25K fine for Brenntag

CORNWALL, ONT-Brenntag Canada was fined $25,000 and levied a victim fine surcharge after pleading guilty to violating Ontario's Environmental Protection Act (EP Act). The company blends and repackages various chemical products at its Cornwall, Ont facility to fill custom industrial and commercial orders. A spill on June 13, 2005 released an estimated 112 kilograms of a product containing a significant volume of hydrogen peroxide. The incident occurred while product was being transferred from a transport vehicle to an on-site holding tank. The material spilled onto a gravel surface and was subsequently contained on-site and diluted with water. Brenntag did not notify the Ministry of Environment (MOE) about the spill until two days later, however, contrary to section 92(1)(a) of the EP Act requiring immediate reporting of a spill. The company pleaded guilty to a charge of failing to notify the ministry of a spill and was fined $25,000.
