Engineering firm fined $12K for failing to file landfill site reports
SARNIA, ONT-BM Ross and Associates, a consulting engineering firm, has been fined $12,000, plus victim fine surcharge, in connection with failing to file annual reports for four landfill sites in southwestern Ontario, as required under the Environmental Protection Act (EP Act). The firm was retained by the Municipality of Bluewater to monitor and report on the operation of three landfill sites. BM Ross was also retained by the Municipality of South Huron to continually assess and report on the operation of another landfill site. These reports are required under Certificates of Approval (C of As) issued to the municipalities for all four sites by the Ministry of Environment (MOE). Between March 31, 2000 and April 30, 2004, BM Ross failed to submit annual reports for the landfill sites to the MOE as required by the C of As. As a result, the firm was charged with, and pleaded guilty to, a charge of violating Section 186(3) of the EP Act by failing to comply with a term or condition of a C of A. BM Ross has since corrected the reporting deficiencies.
