Alberta Environment ordered to disclose former service station soil condition records
EDMONTON, ALTA-Adjudicator Dave Bell, of Alberta's Office of the Information and Privacy Commissioner, has ordered Alberta Environment to disclose records relating to soil conditions at the site of a former service station in Edmonton. The directive follows a request for access to the records under the Freedom of Information and Protection of Privacy Act. A third-party submission sought to block such access, claiming that disclosure of the records would be harmful to its business interests as per section 16 (business interests) of the Act. However, the Adjudicator determined the records did not meet the three-part test necessary for withholding records under that section.
