C&D material importer guilty of violating condition of approval
FREDERICTON, NB-Kingsway Industries, based in Chipman, was found guilty of a charge under section 33(1)b) of New Brunswisk's Clean Environment Act in connection with a trial project of importing construction and demolition material from the United States. The material was to be processed into a value-added product and exported back as hog fuel. The Department of the Environment and Local Government had granted Kingsway Industries a certificate of determination under the Environmental Impact Assessment Regulation. Its terms required that the amount of material being imported would equal the amount being exported. An investigation by the department, however, found that more material was being imported than exported. The company was charged with failing to comply with a term or condition of its Certificate of Determination and was fined $1,000. The maximum fine under provincial legislation for a company is $1 million.
