Praxair fined $60K for non-compliance with C of A terms
SARNIA, ONT-Praxair Canada was fined a total of $60,000 and levied plus a 25% victim fine surcharge after pleading guilty to two charges of non-compliance with its certificate of approval (C of A) for industrial sewage issued by the Ministry of Environment (MOE). The C of A for the company's gaseous and liquid oxygen and nitrogen production facility in Sarnia requires monitoring reports concerning failed lethality tests to be submitted to the ministry. Believing it was to report after three instances of failed testing, Praxair contacted the MOE after it failed toxicity tests for Daphnia Magna on three separate occasions. The Ministry requires the company to report all failed tests immediately. Reporting failed lethality test results both orally and in writing as soon as reasonably possible is required by Ontario Regulation 64/95 under the Environmental Protection Act; failure do to so violated Reporting Section 7(1) of Praxair Canada's C of A. Praxair was fined $30,000 on each charge.
