Scrap metal site owner levied $110K fine for improper waste disposal

PICTON, ONT-A $110,000 fine, plus victim fine surcharge, has been levied against the owner of a scrap metal operation in Prince Edward County. Laverne Valleau pleaded guilty to a charge under Ontario's Environmental Protection Act count of operating, enlarging and extending a waste disposal site without approval from the Ministry of Environment (MOE). He was also ordered to remove all waste from the site in accordance with environmental regulations by December 16, 2005. An MOE inspection in April 2004 found large volumes of waste on the County Salvage property, including construction and demolition waste, household waste and several hundred propane tanks. Further investigation by the ministry's investigations and enforcement branch revealed that no certificate of approval (C of A) allowing waste to be accepted or deposited at the site had been issued to the owner or the business. Valleau was charged with operating a waste disposal site without a C of A, contrary to section 27(1)(b) of the act; this is an offence under Section 186(1) of the act.
